My neighbor is constructing a huge outdoor kitchen that will obstruct our view, light, wind, and air?

I was wondering if there is a Texas law / property right against this. We tried contacting homeowner's association but we need reputable sources as to why they must stop contraction.

  1. Stinks for you.. it's their property, and they can do anything they want.. if you really want to contact someone about it, I'd keep on calling the same home owners association.
  2. Find out your states laws with regard to interfering with someones light. In some places (if not all) that's ilegal.

According to http://recenter.tamu.edu/pdf/1092.pdf: "An owner of real estate may, in the absence of building restrictions or other regulations, erect a building, wall, fence or other structure on the property, even if it obstructs a neighbor’s vision, light or air and even if it depreciates the neighbor’s land. However, owners cannot use their property in a way that constitutes a nuisance"
  4. All depends on the laws where you live. If it's okay by the homeowner's association and it's okay by the building codes where you are, there's not a thing you can do about it no matter how awful it is.
