How to patent and idea when the application is unique - but is using common items?

Not to give away my idea - I am going to change around some "items" ... For example - patents exist already for picture hanging hooks - however if I wanted to improve on the design of the hook and use that hook on something other than a wall - would it be approved? is a patent applicable?

  1. An idea cannot be patented. You can only patent a device or process. If you are altering an existing item, the patent agency will determine if the changes are significant enough to consider it a completely different item from previously patented devices. In a case like this it would probably be helpful to consult with someone directly who assists inventors with obtaining patents, who could help you figure out if it's worth the time and money to pursue a patent.
